Residential property insurance claims are intended to help you recover compensation after an accident or disaster damages your home. For example, if a particularly destructive thunderstorm caused exterior damage to your roof, you could file a residential property insurance claim. In Texas, a homeowner has a Two-Year Deadline from the time the damages accrued to file a claim against their insurance company.

How Can Mclaurin Law Help You?

Our legal team is ready and willing to hear your story. We have experience handling litigation, mediations, and arbitrations in a wide variety of insurance-related disputes, including, but not limited to:

Types of Homeowner Insurance Coverages

Most Texas Homeowner Insurance Policies cover these six areas.

  • Dwelling coverage - covers damage to or destruction of your home, so long as it falls under your policy coverage.
  • Personal property coverage – covers items you own, such as furniture, clothing, etc., in the event it is stolen, damaged, or destroyed.
  • Other structures coverage – covers damage or destruction of structures on your property other than your home. This can include garages, sheds, guest homes, and more.
  • Loss of use coverage – covers additional living expenses if you must move while your house is being repaired to fix damages covered by your policy. Additional living expenses include rent, food, and other costs you wouldn’t have if you were still in your home.
  • Personal liability coverage – covers medical bills, lost wages, and other costs for people you are legally responsible for injuring. It also pays if you’re responsible for damaging someone else’s property and court costs if you’re sued because of an accident.
  • Medical payments coverage – covers medical bills of people hurt on your property. It also may cover some injuries that happen away from your home; for example, if your dog bites someone while out for a walk.

Working With Your Insurance Adjuster

Your insurance company will most likely send an adjuster to your home soon after you file your claim. Unfortunately, these adjusters aren’t always on your side. They’re hired by your insurance company, which means they might not have your best interests in mind. The first thing you should do when dealing with an adjuster is to ensure they have the right credentials to assess your home and its damage.

When the adjuster arrives, you should:

  • Ask them the exact reason for their visit and what their intentions are
  • Ask for a business card
  • Note their first and last name
  • Note their state license number
  • Provide this information to your attorney

Should I Get a Homeowner’s Insurance Claim Lawyer?

Maybe you are the type of person who is hesitant to sue. Still, you’ve dutifully paid your insurance premiums specifically for moments like these. You’ve already paid for coverage. Shouldn’t you get it?

Shouldn’t your insurance now work for you? If so, hiring a homeowner insurance claim attorney is, unfortunately, a reality for ensuring you get what is right.

Hail Insurance Claims in Texas

In 2020 Texas had the highest number of properties affected by hail, over 1.5 million properties, accounting for almost a quarter of total U.S. properties affected. Many Texas Insurance companies don’t inherently cover hailstorm damages. You will need to purchase a separate “Wind and Hailstorm” Insurance policy to have coverage benefits. In your case assessment, we will review your information and craft a case to achieve the best possible outcome.
